New Restatement of the Law of Torts Published by The American Law Institute

The American Law Institute (ALI) today announced the publication of the Restatement Third, Torts: Liability for Physical and Emotional Harm, Volume 2, which completes the project.

Michael D. Green, a professor at Wake Forest University School of Law, and William C. Powers, Jr., president of the University of Texas at Austin, served as the Reporters for this Restatement. Professor Ellen S. Pryor of Southern Methodist University's Dedman School of Law served as Associate Reporter for the chapter on issues relating to independent contractors. They obtained the close review of a diverse group of Advisers who are expert in the tort field and of ALI's Members Consultative Group. A complete list of members of those groups is available on the ALI website at www.ali.org.

Professor Kenneth S. Abraham of the University of Virginia School of Law, an Adviser on the project and a member of ALI's Council, said the publication of Volume 2 "is an important event in American tort law."

"For courts, practitioners, and scholars," Professor Abraham said, "the material addressed in this volume provides a rigorous and up-to-date restatement of modern developments in the field. This material will undoubtedly play a significant role in the development of the law of torts in the twenty-first century."

The 686-page Volume 1, published in February 2010, covered basic topics of the law of torts:

  • Liability for Intentional Physical Harm
  • Liability for Negligence Causing Physical Harm

  • Strict Liability
  • Factual Cause
  • Scope of Liability (Proximate Cause)

The new 538-page Volume 2 covers

  • Affirmative Duties
  • Liability for Emotional Harm
  • Duty of Land Possessors
  • Liability of Those Who Hire Independent Contractors
    • Direct Liability in Negligence
    • Vicarious Liability
