Dario U Oscós Coria is a legal counsel and practitioner specialising in insolvency, restructuring, creditor rights, litigation, arbitration and mediation, in both domestic and international litigation within a wide variety of industries that range from banking, securities, energy, oil, gas, construction, industrial property, copyright, torts and finance to telecommunications.

Mr. Oscos is and acts as a Mexican legal expert in cross border cases. 

Mr. Oscos set a milestone by successfully adjudicating the first two cases in the world that recognised and fully enforced another country’s insolvency proceedings under the UNCITRAL Model Law on Cross-Border Insolvency (Xacur and IFS Financial Corporation)

Notably, in the IFS case, under the umbrella of the recognition in Mexico of US Bankruptcy Adjudication and US Trustee, a number of US adversary proceedings final judgments were recognized and enforced as well as voidance actions. Estate assets were recovered and sent to the US Bankruptcy court for distribution. 

Mr. Oscos successfully concluded a complex RICO action proceeding (Racketeer Influenced and Corrupt Organizations Act) with cross-border insolvency and criminal implications in USA, UK and Mexico. 

In the Vitro case, representing one dissenting creditor trust indenture, he strongly litigated the Vitro´s concurso mercantil up to a successfully cross border final settlement and release of legal actions pending decision. Most notably, the Vitro case gave rose to the most important ever amendments of the Ley de Concursos Mercantiles entered into effect as of January 2014.

Mr. Oscós has participated in ICC and LCIA as arbitrator in major oil and gas arbitrations as well as major energy and construction disputes. 

He participates actively as International Insolvency Institute´s delegate at UNCITRAL Working Group V Insolvency and WG II Dispute Resolutions.

Mr Oscós has also been a professor of procedural law at the Escuela Libre de Derecho and Universidad Iberoamericana; of insolvency at Universidad Panamericana; and of arbitration at the Instituto Tecnologico Autonomo de Mexico (ITAM). 

He is a member of the American College of Bankruptcy, the American Law Institute (and Mexican delegate and adviser in its transnational insolvency project), the International Insolvency Institute, the International Bar Association, wherein he was Insolvency Section Co-chair, the Insol International, of Barra Mexicana Colegio de Abogados and Ilustre y Nacional Colegio de Abogados de México. 

He is a lecturer and author of judicial literature.

He graduated from and was a professor of Procedural Law at the Escuela Libre de Derecho. He studied conflict of laws as a postgraduate at Harvard University. He studied postgraduate on Constitutional and Amparo Law. He was the senior litigator at Santamarina & Steta SC as well as the senior litigator and corporate lawyer at Grupo Financiero Banamex Accival.
