What Happened Today at the Annual Meeting – Tuesday Edition
The first project on the second day of the Annual Meeting was Torts: Medical Malpractice. Council member Jeffrey Sutton joined Reporters Nora Freeman Engstrom, Michael Green, and Mark Hall to present Tentative Draft No. 2, which includes Sections on the Standard of Reasonable Medical Care, Establishing Breach of the Standard of Care, Res Ipsa Loquitur, Lost Chance, Agreements Affecting Medical Liability, Agreements to Take a Nonstandard Approach to Care, Informed Consent, Medical Institutions’ Duties, and Vicarious Liability, among others.

Membership voted to approve the draft, marking the completion of this project.
Today’s luncheon featured a discussion on the topic of public trust in the courts with ALI Director Diane P. Wood, former chief judge of the U.S. Court of Appeals for the Seventh Circuit, and Chief Judge Anna Blackburne-Rigsby of the District of Columbia Court of Appeals, and Tani Cantil-Sakauye, former chief justice of California, current president and CEO of the Public Policy Institute of California.
The next project on the agenda was Copyright, chaired by Council member Wallace B. Jefferson. Reporter Christopher Jon Sprigman and Associate Reporters Lydia Pallas Loren, R. Anthony Reese, and Molly S. Van Houweling presented Tentative Draft No. 5. This draft includes portions of Chapter 2 (Scope of Protection), Chapter 6 (Copyright Rights and Limitations), Chapter 7 (Copyright Infringement), Chapter 8 (Secondary Liability), Chapter 10 (Safe Harbors, Copyright Protection Systems, and Copyright Management Information), and Chapter 11 (Procedural Issues and Relationship to Other Bodies of Law).

The final project session of the day was Torts: Remedies. Reporters Douglas Laycock and Richard L. Hasen were joined on the dais by Council member Laura Denvir Stith. Tentative Draft No. 3 includes the remainder of Topics 1 and 2 of Chapter 1 (Compensatory Damages), all of Chapter 2 (Other Monetary Remedies), and material from Chapter 3 (Injunctions and Other Forms of Specific Relief).
