New Principles Volume on Aggregate Litigation Is Published

The highly anticipated Principles of the Law of Aggregate Litigation is now available. Containing Chapters on definitions and general principles, aggregate adjudication, and aggregate settlements, the volume aims to supply up-to-date coherence to the law of aggregate litigation, which has changed significantly in recent years. The Reporter for this official text is Samuel Issacharoff, of New York University School of Law, and the Associate Reporters are Robert H. Klonoff, of Lewis and Clark Law School, Richard A. Nagareda, of Vanderbilt University Law School, and Charles Silver, of the University of Texas School of Law.

These Principles seek to help judges, legislators, and others make the aggregation decision correctly. They also aim to improve the management of cases in which aggregation is allowed, to provide the framework for recommended law reform, and to supply some language suitable for inclusion in statutes or rules. In addition to formal aggregation in litigated settings, such as with class actions, the volume addresses a broader array of cases that are bundled together and settled or tried to test the value of related claims. It is already clear that American courts are citing the recommended Principles and that law-reformers in Europe and Asia are finding the Principles useful as their countries consider procedural changes that would increase the use of collective lawsuits.
